Arrestment is a highly effective diligence in recovering debt but there can be problems and difficulties in its practical operation. The Bankruptcy and Diligence (Scotland) Act 2007 provided some solutions in relation to the amount of debt caught by an arrestment and a procedure for the automatic release of arrested funds. However, some the key aspects of the diligence, such as arresting an obligation to account or future and contingent debts, remain obscure. This webinar will explore these issues in the context of situations where a solicitor has or will receive funds from a client.
